Frequently asked questions

Short answers about the most common procedures. For specific cases, the first consultation with the firm is free.

What is the difference between a trademark, a patent, and copyright?

A trademark identifies products or services in the marketplace (Law No. 22,362). A patent protects technical inventions (Law No. 24,481). Copyright protects creative works from the moment they are created, with optional registration for certain evidentiary purposes.

Can I register a trademark myself with the INPI?

Yes, the procedure is available online. But the prior-rights search, the drafting of the list of products and services, and the response to office actions require technical judgment. A mistake in the Nice classes or in the description can leave you without real protection.

How long does a trademark registration take in Argentina?

It depends on the complexity and on whether there are oppositions. Under normal conditions, the process can take between 8 and 18 months from filing to the grant of the registration certificate.

Does registering with the INPI protect my trademark in other countries?

No. The Argentine registration protects you throughout the national territory. Abroad, you need local registrations or, in some cases, the Madrid System for trademarks (Argentina is not a member, so filings from Argentina go through local correspondents).
