Patent Registration in Argentina: patent your invention

We assess whether your development is patentable, draft the claims that actually protect it, and handle the procedure before the INPI (Argentina’s National Institute of Industrial Property) from start to finish.

FIRST THINGS FIRST

What can be patented (and what can't)

A patent protects inventions that are new, involve an inventive step, and have industrial application: products, devices, processes, formulations. Abstract ideas, discoveries, business methods, and software as such cannot be patented — although many developments that look “non-patentable” do have protectable aspects when they are framed correctly. That is why the first step is always the patentability analysis: we tell you frankly whether your case has a real chance and which route is the best fit (patent, utility model, industrial design, or trade secret).

OUR SERVICE

What our service includes

Patentability analysis with a prior-art search.

Technical and legal drafting of the application. The claims are the heart of the patent: they define exactly what is protected. Weak drafting makes a patent easy to design around.

Filing and prosecution before the INPI: responding to office actions and following up on substantive examination.

International strategy. If your market extends beyond Argentina, we advise you on priority and foreign filings (PCT / Paris Convention) within the applicable deadlines.

Patent vs. utility model: which one is right for you

If your development is a functional improvement to a known object, tool, or device, a utility model is usually the fastest and most affordable route: it has fewer requirements and protects for 10 years. An invention patent requires absolute novelty and an inventive step, and protects for 20 years. In the first consultation we define which one applies to your case. To see what kinds of improvements fit this category, take a look at these examples of utility models (in Spanish).

HOW IT WORKS

The procedure,
step by step

Important: if you have already disclosed your invention publicly (trade shows, social media, sales), contact us as soon as possible: there is a limited grace period and every month counts.

Confidential, with a non-disclosure agreement if you request one.

Specification, claims, and drawings: the heart of your protection.

From that moment on, you have a priority date.

We respond to the examiner’s office actions.

Protection for 20 years from the filing date.

FREQUENTLY ASKED QUESTIONS

Frequently asked questions about patents

Ideas in the abstract cannot be patented; their technical implementation can. If you have a developed idea — even just in drawings or a prototype — we can assess which aspects are protectable.

It depends on the technical complexity of the invention (which affects the drafting) and on the INPI’s fees. Ask us for a quote: we price it after a free initial assessment.

Substantive examination can take several years, but your protection runs from the day of filing: you can mark your product “patent pending” and your priority is already secured.

Sometimes it is (formulas or processes that are hard to reverse-engineer). We evaluate it case by case: it is a strategic decision, not a form to fill in.
